Interpretation of the Vietnamese Government's New Decree No. 74/2018/ND-CP:

No. 74/2018/ND-CP is a new regulation issued by the Vietnamese government, which is used to stipulate that the second-class products exported to the Vietnamese market must obtain the quality inspection registration of imported products in Vietnam, that is, PQIR registration. The main content of this PQIR registration is: no matter how many times you enter the Vietnamese market with the same type of product, you must obtain PQIR, that is, you need to obtain PQIR for each batch, also called batch inspection. Moreover, the MIC of the Ministry of Communications and Information of Vietnam also stipulates that as long as the products under its control must apply for PQIR, the battery part is no exception, from the original DOC to SDOC (issued by the importer), these two are indispensable, Otherwise, customs clearance procedures cannot be completed at Vietnam Customs. This Vietnam PQIR regulation has come into effect in August 2018.

Vietnam MIC certification is a certification requirement for electromagnetic interference of information technology equipment and communication equipment. Whether locally produced or imported in Vietnam, all telecommunications products within the scope of the compulsory certification catalogue published by the Ministry of Information and Communications of Vietnam (MIC) must meet the requirements of the relevant QCVN/TCN standards.

The Ministry of Communications (MIC) of Vietnam has released a draft new wireless regulation to replace the wireless regulation Circular 05/2019/TT-BTTTT, which was implemented in September 2019. The Act came into effect on July 1, 2020.

Change Content:

Compared to Circular 05/2019/TT-BTTTT, the new regulations will make changes in the following areas:

1. Update 2G/3G/4G RF EMC standard version:

• The new version QCVN 86:2019/BTTTT will replace the previous QCVN 86:2015/BTTTT.

2. 5G technology will soon be commercially available in Vietnam:

• For 5G terminal products, the current reference standards are QCVN 47:2015/BTTTT and QCVN 18:2014/BTTTT.

3. Added QCVN 119:2019/BTTTT test standard:

• The new standard will apply to the marine field and other wireless communication terminal products specified in the SDoC list.

4. Move the following products into the SDoC list:

• Medical products that use MICS and MITS related frequency bands;

• UWB devices;

• 60GHz equipment;

• Wireless audio equipment (such as wireless microphones, speakers, headphones) use related equipment in the 25MHz-2000MHz frequency band;

• Wireless charger.

Certification Procedure:

From the date of implementation of the new regulations, the products moved into the SDoC list only need to apply for SDoC, and no additional application for MIC certificate is required. Before ordinary SRD and mobile communication products enter Vietnam, the process of applying for MIC certificate remains unchanged.

Basic Certification Information:

• Mandatory: mandatory for products in the regulatory list, voluntary for other products
